Terms of service

Effective October 1, 2026

Northlit (northlit.ai) is an AI design suite operated by 3 Elements Design. These terms govern your use of Northlit in the browser, through the API, and through any AI agent you connect over MCP. By creating an account or using the service you agree to them, and to our privacy policy.

Your account

You sign in with an email and password or with a Google or Apple account, and are responsible for what happens under it, including anything an API key or connected agent does on your behalf. Keep your keys private and revoke any you no longer use in Settings → API. You must be at least 18, or the age of majority where you live, and if you use Northlit for an organization you confirm you can bind it to these terms.

Plans, credits, and billing

Generation is metered in credits. Every new account receives 25 welcome credits with no card required. Paid plans (Pro, Studio, Agency, and Enterprise) include a monthly credit allowance that refreshes each billing cycle; daily and feature-specific limits still apply and are shown in the app. Purchased credit packs do not expire and are used after plan credits.

Plans renew automatically until you cancel, which you can do at any time from Settings → Billing; cancellation takes effect at the end of the current cycle and you keep access until then. Payments are processed by Stripe. Credits are consumed when a generation runs and are not refundable once used; where a generation fails on our side, the credit is not charged. We may change prices or plan contents with notice before your next renewal.

Your content

You keep ownership of what you bring to Northlit: briefs, prompts, reference images, logos, brand assets, and guidelines. You grant us a license to store, process, display, and transmit that content as needed to run the service, including sending prompts and references to the AI model providers that fulfil your requests. You are responsible for having the rights to anything you upload, particularly brand assets and logos, and for how you use what you make.

Generated output

Subject to these terms and to the terms of the model providers involved, you own the images, video, 3D models, audio, prototypes, and code Northlit generates for you, to the extent permitted by law. Generated output may not be unique: other people's prompts can produce similar results, and we cannot guarantee that output is free of third-party rights. Review output before you publish it, especially anything that includes trademarks, people, or claims of fact. AI output is not professional advice.

Acceptable use

Do not use Northlit to generate content that is illegal, that infringes someone else's rights, that depicts real people in a misleading or sexual way, that is intended to deceive, or that violates the usage policies of the model providers that serve your request. Do not probe, overload, or interfere with the service, scrape it, resell access to it, or share accounts or keys to get around plan limits. We may remove content or suspend accounts that break these rules.

Agents, API keys, and connections

API keys and OAuth connections act as you: anything an agent creates, reads, publishes, or spends happens under your identity and billing. Tools that cost credits say so in their descriptions, and an agent cannot spend past your balance. You can see and revoke every key and connection in Settings → API, which ends that access immediately.

Publishing and sharing

Your work is private by default. Publishing a prototype, minting a build handoff link, or sharing a board or brand book creates a URL that anyone holding it can open. You decide when to do that and can unpublish or stop sharing at any time; copies others have already made are outside our control.

Third-party services

Generations run on third-party AI models (such as those from Anthropic, OpenAI, Google, and fal.ai) under our agreements with them, and if you configure your own provider keys, under your agreements with them instead. Those providers' terms apply to the requests they serve. We are not responsible for third-party services, including the AI agent you choose to connect.

Our intellectual property

Northlit, including its software, design, skills library, and documentation, belongs to 3 Elements Design and its licensors. These terms give you a limited, revocable, non-transferable right to use the service; they do not transfer any ownership of it. Feedback you send us may be used without obligation to you.

Disclaimers and liability

Northlit is provided as is and as available. We do not promise uninterrupted or error-free service, or that output will meet your needs. To the fullest extent permitted by law, 3 Elements Design is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the service, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Termination

You can stop using Northlit and ask us to delete your account at any time. We may suspend or end your access if you break these terms or if the law requires it, and will tell you why unless we are not permitted to. Sections about your content, generated output, intellectual property, disclaimers, and liability survive termination.

Governing law

These terms are governed by the laws of the United States and of the state in which 3 Elements Design is organized, without regard to conflict-of-law rules, and disputes will be brought in the courts there. If any part of these terms is found unenforceable, the rest remains in effect.
